TERMS AND CONDITIONS

(RIDER AGREEMENT)

Risky Pass SL with VAT number B67771071 and registered address at C/Duque de Osuna, 6 2Cext, 28015 Madrid, Spain (“BADLANDS”) manages a bike route through Southern Spain (the “Route”).

This rider agreement (the “Rider Agreement”) contains the Terms and Conditions that will govern (i) the draw to select participants in the Route (“Participants”), and (ii) your participation in the Route as a rider (“Rider”):

1. SELECTION OF RIDERS: DRAW TERMS AND CONDITIONS

1.1. Acceptance of this Rider Agreement is a prerequisite for your participation in the draw to select the Riders of the Route. By ticking the box, you declare that you accept the terms and conditions contained in this Rider Agreement.

1.2. The participation in the draw is free. However, if you are selected as a Rider after the draw, you must pay the corresponding fees to participate in the Route.

1.3. The Participant must meet the conditions to participate in the Route as a Rider. In case of non-compliance, the Participant will be eliminated from the draw or, if selected, his/her right to participate will be withdrawn.

1.4. The Participant is only entitled to participate once in the draw and only for one of the categories (Solo or Pair). Duplicated applications will be removed.

1.5. BADLANDS will raffle a minimum of 160 places. BADLANDS reserves the right to keep remaining seats in the Route for its own purposes or commitments.

1.6. Applications for the draw are open from 10/Nov/2023 20:00 to 15/Nov/2023 20:00 (CET). Any petition for participation in the draw received outside the above term will not be valid.

1.7. The prize of the draw will be the right to register to participate in the Route as a Rider.

1.8. The draw will be carried out among the Participants by means of a software that guarantees randomness in the selection of the winners. The software to be used will be provided by an independent third party.

1.9. The draw will take place on 20/Nov/2023.

1.10. After the draw, BADLANDS will contact the selected Participant by email in order to inform him/her that he/she has been selected as Rider. Since then, the selected Participant must complete the registration and pay the corresponding fee of the Route by bank transfer following the instruction provided by BADLANDS. In case of non-payment or no registration within a period of 5 days, the selected Participant will lose his/her right to register and will be added to the wating list.

1.11. The Participant who is not selected to be a Rider will be also contacted by BADLANDS by email and included in a waiting list. In the event that any selected Participant withdraws or loses his/her right to participate in the Route, BADLANDS may contact a Participant included in the waiting list to inform him/her that he/she has been selected to participate in the Route.

1.12. If the places are not covered by the applications BADLANDS will extend the registration period.

1.13. BADLANDS reserves the right at its sole discretion, to reject those duplicated, incorrect, malware or malicious applications and/or registrations. BADLANDS will not be responsible for incomplete entries, declined bank transfers, nor information received after the deadlines.

1.14. The terms and conditions of the draw are governed by Spanish law.

1.15. Any litigation, discrepancy, question or claim resulting from the execution, interpretations of the terms and conditions of the draw, shall be resolved by the Courts of Madrid, Spain, to which the parties submit renouncing any other that may correspond to them.

2. GENERAL PROVISIONS

2.1. Acceptance of this Rider Agreement is a prerequisite for participation in Badlands. The Rider declares to accept the terms and conditions contained in this Rider Agreement together with the Rules described in the website https://badlands.cc/rules

2.2. The Rider acknowledges being of legal age at the start.

2.3. The Rider accepts that Badlands is not a competitive event, but a self-supported and personal bike adventure where she/he shall not have any planned assistance during the entire Route. The Rider shall be solely responsible for planning and carrying out by her/him own ride and her/him own assistance. Accordingly, the Rider understands she/he shall not find any neighbourhood services or assistance from the organization during the Route.

2.4. The Rider shall bring the following documents for accreditation: ID document, signed official rider agreement, copy of a valid insurance and the tracker refundable deposit.

2.5. The Rider declares to have consulted her/his GP who has confirmed that she/he can participate in the Route, exempting BADLANDS from any liability.

2.6. The Rider undertakes to respect the timeline, including enrolment, accreditation, start and time limit.

2.7. BADLANDS is not obliged to provide any ride marshals. The Rider shall take all required precautionary measures in the Route to ensure third parties and her/him own safety.

2.8. The Rider understands the Route has risks inherent with bike riding. The Rider declares she/he voluntarily participates in the Route with knowledge of the hazards involved and accepts all risks of injury, inconvenience, harm, loss or death, acknowledging BADLANDS shall not be liable under any circumstance for any material damages or personal injury that may occur during the Route.

2.9. The Rider shall take out valid liability, death, accident and health insurance valid during the event, covering emergency extraction and repatriation insurance.

2.10. The Route is being conducted on public roads to which third parties (motor vehicles) have access. The Rider shall comply with local laws and all instructions and regulations issued by the organization during the Route.

2.11. The Rider undertakes to wear while riding reflective vest and lights at night, and helmet at any time.

2.12. The Rider shall agree with all decisions by organisers, including time penalties or ejections.

2.13. BADLANDS reserves the right to exclude any Rider from the Route or the Roster who does not comply with this Rider Agreement or whose behaviour may affect the Route without prior notifications.

2.14 BADLANDS reserves the right to modify the timeline and/or to organize a waived start. 

2.15. Once the registration process is done, the Rider will receive a provisional email. The final confirmation will be sent once the information is verified. BADLANDS reserves the right to reject those incorrect, malware or malicious registrations.

2.16. BADLANDS may publish the final times and results on its website.

3. RIDER LOCATION

3.1. BADLANDS shall provide Riders with a device to enable them to know their live location and the location of other participants during the Route. The Riders’ location shall be public and available through BADLANDS website. The Rider shall be able to choose their username used to identify her/him on the map during the registration process. BADLANDS shall process the Rider location according to its Privacy Policy, which can be found at the following link: https://badlands.cc/privacy-policy/

3.2. The Rider undertakes to carry the mentioned tracker during the Route.

3.3. The Rider shall pick up the tracker before the start. The Rider shall provide a refundable deposit to guarantee the integrity of the tracker. In the event of any damage to the tracker, the deposit shall cover the damages suffered.

4. PAYMENT AND REFUND PROVISIONS

4.1. The fee for the participation is 295€ for Solo Category and 580€ for Pair category (VAT included). This fee includes: Tracker rental, Official cap, Welcome Pack, T-Shirt, Official Track, Handbook, Live real time satellite tracking. The fee must be paid by bank transfer, other payment methods are not allowed.

4.2. The refunds policy can be found at the link https://badlands.cc/refunds-policy/ and includes the following conditions:
• Refund until 30/Apr/2024: 70% of entry fee.
• Refund since 01/May/2024 until 15/Jul/2024: 50% of entry fee.
• No refunds after 15/Jul/2024

• The entries are not deferrable.

4.3. If the event is cancelled as a result of COVID-19 local restrictions, natural disaster, war, strike, legal interventions, major accidents during the event, pandemics, lockdowns or other such causes, Badlands will reschedule the event. In this case the riders would have two options: first to keep the place for the new date, second -during a limited period of time- a refund of 80% of entry fee. In case of adverse weather or risk conditions the track will be partially rerouted. Once the event has begun, no refund will be offered if it is cancelled, postponed or rerouted.

4.4 Any change of category proposed by the riders will have a charge of 30€/rider. No changes allowed after 30/Jun/2024.

5. ROUTE FILMING

5.1. During the Route, there will be professional photographers and film crew on behalf of BADLANDS (“Media Team”). The Media Team will be visible and easily recognisable at any time. In addition, the content will be used for BADLANDS promotional and/or communication purposes. This content may be published in any media globally, including the Internet, print and digital media, as well as on social media profiles. By signing this Rider Agreement, the Rider authorises BADLANDS to record her/his image during the Route, including the editing of the images, for the purposes above mentioned.

5.2. In any case, if the Rider does not consent the capture of her/his image or she/he wishes us to remove a published image, an email to info@badlands.cc should be sent identifying the image to remove.

5.4. The Rider understands BADLANDS is the owner of all rights over intellectual property, including pictures and videos, taken from the official media crew.

5.5. The Rider is not allowed to record or capture images of other Riders without their prior authorisation. If a Rider wants to use her/his participation for commercial purposes, including or not professional recording staff, a Media Licence (ML) will be required for each sponsor or brand promoted. To apply for the ML she/he must contact info@badlands.cc before 31/May/2024, explaining the project and the brands involved. The applications may be refused. In any case, such licence shall not imply acceptance of liability on the part of BADLANDS with regard to an infringement of the applicable regulations.

6. COVID-19 PROVISIONS

6.1. The Rider declares to have not had fever, deep cough or other COVID-19 symptoms the days before the start of the Route.

6.2. In case the Rider has COVID-19 symptoms during the Route or within the 14 days after, she/he shall inform immediately the organisation.

7. DATA PROTECTION

7.1. The data controller of the personal data is Risky Pass, S.L., with VAT number B67771071 and registered address at C/Duque de Osuna, 6 2Cext, 28015 Madrid, Spain (“BADLANDS”), who will process the personal data to manage the registrations and provide the Riders with the requested services.

7.2. The Rider has different privacy rights, such as the right of access to her/his data, the right of erasure, the right of rectification, the right to restriction of processing or the right to object processing among others.
